By accessing and using the SpeakSafely, you agree to the following Terms of Use. Please read them carefully before using our services.
This English version is a convenience translation. For Brazilian legal and compliance purposes, the Portuguese text is the reference version.
1. About SpeakSafely
SpeakSafely is a digital whistleblowing and corporate ethics-hotline platform, operated by a company based in Porto Alegre, RS, Brazil. The service is provided exclusively to business customers (B2B) that contract the platform to receive and manage reports from employees, partners, and third parties.
2. Acceptance of the terms
Using SpeakSafely means you have read and accepted these Terms of Use in full. If you disagree with any point, you should not use the platform.
3. Proper use of the platform
You agree to use the platform only for legitimate purposes, including:
- Reporting misconduct, ethics violations, or risk situations truthfully
- Managing received reports impartially and within legal deadlines
- Using investigation tools ethically and responsibly
It is expressly prohibited to: submit false, slanderous, or defamatory reports; use the platform for harassment or stalking; attempt to identify anonymous reporters by unauthorized means; or attempt to bypass anonymity mechanisms.
4. Responsibility for content
SpeakSafely acts as an intermediary technology platform. Report content is the responsibility of the person who submits it. SpeakSafely does not verify the truth of reports and is not responsible for decisions customer companies make based on received reports.
5. Reporter protection
SpeakSafely commits to technically protecting reporter anonymity when requested. However, if a court so orders, SpeakSafely may be required to provide information to competent authorities as the law determines.
6. Intellectual property
All rights in the SpeakSafely brand, software, design, and documentation belong exclusively to SpeakSafely. Reproduction, copying, or distribution without prior written authorization is prohibited.
7. Limitation of liability
SpeakSafely is not liable for indirect, incidental, or consequential damages arising from use of the platform. SpeakSafely’s total liability is limited to the amount paid by the customer in the last 3 months of service.
8. Service availability
SpeakSafely aims for 99.5% monthly uptime. Scheduled maintenance will be communicated at least 48 hours in advance.
9. Termination
Customers may cancel the service at any time without a penalty, with 30 days’ notice. SpeakSafely may suspend or terminate access in case of misuse of the platform.
10. Governing law and venue
These Terms are governed by Brazilian law. The parties elect the courts of Porto Alegre, RS, to resolve any disputes.
